In this news item we clarify the position regarding termination dates for teaching staff leaving their post at the end of the Spring term.
Under their terms and conditions of employment a teacher can usually only resign with effect from the end of the notional term.
In the Spring term the end of the notional spring term is 30th April - however the correct termination date will vary depending on the future destination of the teacher .
Where a teacher is taking up another teaching post:
If a teacher is starting in a new post immediately after the Easter break – they should be paid up until the last day of the Easter break (ie 15th April 2018) in their current role and start their new post from the first day of the new term (ie 16th April 2018).
Where a teacher is retiring or not continuing in employment:
The teacher can be required to work until 30 April and receive normal salary until that date
Where a teacher is moving into employment outside of teaching:
The teacher can be required to work until 30 April and receive normal salary until this date
If a teacher who is leaving employment / moving to a non teaching post leaves their post in advance of 30 April they are potentially in breach of contract.
Where a teacher wishes to be released in advance of 30 April schools do have discretion to agree to an earlier release date - but there is no obligation to do so. Where an early release is agreed, the teacher would be paid until the revised end date.
